The terms and conditions that govern your use of India Imagine.

Welcome to India Imagine. These Terms of Use (“Terms”) constitute a legally binding agreement between you and India Imagine (“we”, “us”, or “our”) governing your access to and use of the website located at www.indiaimagine.com (the “Site”), including all pages, features, content, and services made available through the Site.

By accessing or using the Site, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not access or use the Site. These Terms should be read together with our Privacy Policy, which describes how we collect and use personal information.

1. About the Site

India Imagine is a digital travel publication offering stories, guides, destination features, and related editorial content about India and international travel. The Site is provided for general informational and entertainment purposes.

While we strive to publish accurate and helpful content, information on the Site may become outdated. Travel conditions, prices, opening hours, visa requirements, safety advisories, health regulations, and local laws change frequently. You are solely responsible for verifying any information before making travel decisions or relying on Site content.

2. No professional advice

Content on the Site does not constitute professional, legal, medical, financial, immigration, or travel-safety advice. Nothing on the Site should be treated as a substitute for advice from qualified professionals or official government sources. Always consult appropriate authorities, licensed professionals, and official resources before booking travel, making health decisions, or undertaking activities described in our articles.

3. Eligibility

By using the Site, you represent that you are at least 13 years of age (or the minimum age required in your jurisdiction) and have the legal capacity to enter into these Terms. If you are using the Site on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

  • Frame, mirror, or otherwise republish substantial portions of the Site without our prior written permission

We reserve the right to investigate violations and cooperate with law enforcement or regulatory authorities where appropriate.

5. Intellectual property rights

Unless otherwise stated, all content on the Site — including text, photographs, illustrations, graphics, logos, page layouts, design elements, and software — is owned by India Imagine or our licensors and is protected by copyright, trademark, and other intellectual property laws.

  • Quote brief excerpts from articles for commentary, review, or news reporting, provided you include clear attribution to India Imagine and a link back to the original page

5.2 Restricted use

  • Modify, adapt, translate, or create derivative works based on Site content
  • Use our name, logo, or branding in a manner that suggests endorsement, partnership, or affiliation

6. User submissions and communications

If you submit information to us — including through our Contact form, email, or other channels — you represent that:

  • The information you provide is accurate to the best of your knowledge
  • You have the right to submit the material and that it does not violate any third-party rights
  • Your submission does not contain unlawful, harmful, or confidential information belonging to others

By submitting content to us, you grant India Imagine a non-exclusive, worldwide, royalty-free, perpetual licence to use, reproduce, modify, adapt, publish, and display that material for the purposes of operating the Site, responding to your enquiry, improving our services, and publishing editorial content (for example, story tips or corrections), unless you explicitly request otherwise in writing.

We are under no obligation to use, publish, or respond to any submission. Do not send confidential or proprietary information you do not wish us to receive.

7. Newsletter and subscriptions

If you subscribe to our newsletter or other email communications, you agree to provide a valid email address and to receive messages from us in accordance with your subscription preferences. You may unsubscribe at any time using the link provided in our emails or by contacting us.

We may modify or discontinue newsletter services at any time. Processing of personal data in connection with subscriptions is described in our Privacy Policy.

8. Third-party links, advertising, and services

The Site may include links to third-party websites, social media platforms, maps, booking tools, affiliate partners, and other external resources. We may also display third-party advertising, including through Google AdSense or similar ad networks.

These third parties are not under our control. We do not endorse, and are not responsible for, the content, products, services, policies, or practices of any third party. Any transactions, bookings, or arrangements you make with third parties are at your own risk. We are not a party to, and disclaim all liability arising from, such transactions.

To the fullest extent permitted by applicable law, the Site and all content, features, and services are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied.

Without limiting the foregoing, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and uninterrupted or error-free operation. We do not warrant that:

To the fullest extent permitted by applicable law, India Imagine, its owners, operators, authors, contributors, affiliates, and service providers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunities, arising out of or in connection with:

  • Any conduct or content of third parties, including other users or external websites
  • Unauthorised access to, or alteration of, your transmissions or data
  • Travel decisions, bookings, injuries, losses, or expenses arising from reliance on Site content

To the extent permitted by law, our total aggregate liability for any claim arising out of or relating to these Terms or the Site shall not exceed the greater of (a) the amount you paid us, if any, in the twelve (12) months preceding the claim, or (b) one hundred Indian rupees (₹100).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

11. Indemnification

You agree to indemnify, defend, and hold harmless India Imagine, its owners, operators, authors, contributors, affiliates, and service providers from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use of the Site
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property or privacy rights
  • Any content or information you submit to us

12. Privacy

Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you acknowledge that you have read and understood our Privacy Policy.

13. Suspension and termination

We may suspend or terminate your access to the Site, in whole or in part, at any time and for any reason, including if we reasonably believe you have violated these Terms or engaged in conduct that may harm the Site, other users, or third parties.

Upon termination, provisions that by their nature should survive — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — shall continue in effect.

14. Changes to these Terms

We may revise these Terms from time to time to reflect changes in our services, legal requirements, or business practices. When we make material changes, we will update the “Effective date” at the top of this page.

Your continued use of the Site after updated Terms are posted constitutes your acceptance of the revised Terms, subject to applicable law. If you do not agree to the updated Terms, you must stop using the Site.

15. Governing law and dispute resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict-of-law principles.

Subject to any mandatory consumer protection laws that apply in your jurisdiction, you agree that the courts located in India shall have exclusive jurisdiction over any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site.

16. General provisions

  • Entire agreement — These Terms, together with the Privacy Policy, constitute the entire agreement between you and India Imagine regarding the Site.
  • Severability — If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
  • Waiver — Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
  • Assignment — You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
  • Language — These Terms are written in English. In the event of any conflict between a translated version and the English version, the English version shall prevail.
